Zitacuaro, State of Michoacan de Ocampo, at 15:00 hours, on November 10, 2003 before the undersigned, Asención Estrada Valencia, District Attorney and chief of the Investigative Agency in this city, who acts legally with witnesses mentioned and signed below and certify that Alejo Claudio Cayetano, under oath to tell the truth, said his name was as written, is male, 36 years old, married, country person. from and neighbor of the first block in Crescencio Morales, Zitacuaro municipality, Michoacan, known address, education until sixth grade, he knows how to read and write, as well as sign, who identifies himself with the card issued in his name by the city hall of Zitacuaro, Michoacan, recognizing him as Chief of Landowners in Crescencio Morales, showing a black and white photo that coincides with his physiognomic features and is certified based on numeral 208 from the Procedural Code. Following, the personnel reads the deponent the rights he has in the process of this procedure and that Article 127 of the Federal Code of Criminal Procedures protects him in the sense that he has the right of choosing an attorney to assist him in this sworn statement, sustaining that if he reserves said right, for not considering it necessary, for the type of statement he will give, following:
STATES that his appearance is voluntary, with the effect of reporting against whomever results responsible for the environmental crime, and responsible for damages to the community he represents, and for that he wishes to express, that as stated before, he is chief of landowners in the Crescencio Morales community, elected by the corresponding council, and based on this, and since hills belonging to the community are being heavily affected, the neighbors have communicated the situation, the individuals responsible for illegal logging do so in “Peña Cerrada, Palo Herrado, Lomas de Aparicio” and other places that I don’t currently remember, without authorities having done something to stop them and ignoring who they are. The deponent has visited said places and noticed the stomps located in the monarch butterfly core zone. That he knows this is a protected area according to de Sustainable Forestry Development Federal Law. This is why he comes to this authority with the purpose of having an investigation of the facts and proceed according to the law against whomever is responsible, adding that people who come do so at different hours during the day using considerable amounts of vehicles. People from the community have even mentioned that those responsible might already have an illegal sawmill in the middle of the Sierra, since some of the vehicles that drive down with wood, do so with processed pieces. On recent days the municipal police arrested some people around the places mentioned but not knowing why. He requests that personnel from this institution, as well as from the Procuraduria Federal de Proteccion al Ambiente (PROFEPA) verifies if there is indeed a sawmill, as well as to quantify damages and cost of the extracted wood, which the witness considers plenty. This is detrimental to the environment as well as to patrimonial interests of the community he represents.
